FCCPC Closes PWAN Operational HQs After Failing to Allocate 20 Fully Paid Land Plots to Subscriber

The Federal Competition and Consumer Protection Commission (FCCPC) sealed the operational premises of PWAN Max Property and Business Solution Limited in Sangotedo, along Lekki‑Epe Expressway, yesterday after finding that the company had not allocated 20 fully paid plots of land to a subscriber.

In a press statement, the FCCPC said the sealing followed a consumer complaint that PWAN had failed to hand over the 20 plots that had been fully subscribed and paid for by the customer.

Following the complaint, the commission launched an investigation and subsequently invited PWAN to respond.

The FCCPC noted that PWAN declined to attend two invitations, which led the commission to issue a summons. At the summons, PWAN entered a witness statement and agreed to allocate the 20 plots and provide all necessary documents by 30 June 2025.

However, PWAN did not honour the agreement, so the commission issued a Compliance Notice under Section 150(1) of the Federal Competition and Consumer Protection Act, 2018.

The notice, as required by Section 150(2), detailed the non‑compliance, the steps needed to remedy it, the deadline, and the penalties for failure to comply.

Despite being served with the notice and given a reasonable period to rectify the breach, PWAN failed to comply. Consequently, in exercise of its powers under Section 150(4)(a) of the FCCPA, 2018, the FCCPC shut down the premises until the breach is remedied.

The commission explained that the action is “protective and corrective” rather than punitive. The sealing will remain in effect until the commission is satisfied that the breach has been fully corrected, at which point a compliance certificate will be issued under Section 150(3).

The FCCPC urged all businesses to treat compliance notices seriously, noting that the law does not allow discretion once a clear violation persists after a notice has been ignored.

It also advised consumers to exercise due diligence in all transactions and to verify a business thoroughly before committing money.
